Official Charity Response

In March, 2018 the California Attorney General’s (CAG) office asserted that the Catholic Medical Mission Board (CMMB) was improperly valuing donated medicines by using U.S. wholesale pricing. The CAG alleged this valuation did not comply with Generally Accepted Accounting Principles (GAAP), and that in CMMB’s California solicitations, it was not sufficiently explaining its use of its program efficiency ratio. The CAG issued a narrow cease and desist order requiring CMMB to stop using that ratio in solicitations, CMMB immediately complied with the order.

CMMB did though formally contest the CAG’s order. In September 2019, the CAG issued a two-part decision. In part one, the CAG found that CMMB had in fact properly valued its donated medicines according to Generally Accepted Accounting Principles (GAAP).  In part two, the CAG found that despite no donor or public complaints, CMMB’s use of its program efficiency ratio was potentially misleading and ordered CMMB to permanently stop using that ratio in solicitations.

CMMB continues to comply with the CAG’s request, however in order to protect public confidence, CMMB felt it necessary to formally appeal part two of the CAG decision to the California Superior Court. Given that part one of the ruling agreed that our valuations were correctly completed according to approved accounting standards, CMMB maintains that the use of those valuations to obtain an efficiency rating was correctly applied.  The hearing on part two is scheduled to commence in early 2021, with a final a decision reached by mid-2021.
